The Labour Department of Sikkim on April 25, 2024, issued the Draft Sikkim Occupational Safety, Health and Working Conditions Rules, 2024.
The following has been stated namely: -
• It shall extend to whole of the State of Sikkim.
• It specifies that employers seeking registration for an unregistered establishment shall electronically submit Form-1 with specified details, signed digitally or as required on the portal.
• It mentions that employers of factories, contract labor, building, or construction works shall electronically submit Form-4 to the Registering Officer within 30 days of commencing or ceasing operations, enclosing a notice of cessation with a certificate of payment to workers and hazard-free premises.
• It also states that every employer shall provide free medical examination annually to employees aged 40 or older, drawing wages equal to or less than the specified ceiling under the Social Security Code, conducted by a qualified practitioner as per Form-5, with the option to avail ESIC facilities.
• It specifies the conditions relating to safety, holidays and working hours or any other condition to be observed by the employer relating to employment of women.
• It also specifies special provisions for qualification, criteria and manner of making application for licensing of establishments alongwith Forms, regarding Contract Labour, Inter-state Migrant Worker, Audio-Visual Workers, Beedi and Cigar Workers.
The Objections or suggestions, if any, with respect to these draft rules shall be taken into consideration after the expiry of forty five days from April 25, 2024.
