The Kolkata Municipal Corporation (KMC) on April 18, 2024, issued a notification regarding the Disconnection of Water Supply & Drainage from unauthorised buildings.
The Building Department frequently receives complaints regarding unauthorized constructions within different parts of the city under the jurisdiction of the Kolkata Municipal Corporation (KMC). Upon receiving such complaints, the Building Department conducts inspections of the premises where unauthorized construction is suspected. Subsequently, appropriate actions are taken in accordance with sections 401 and 401A of the KMC Act 1980. Additionally, the local police authority is notified to take action in accordance with the law. Following this, the matter is processed under section 400(1) and/or section 416 or 400(8) of the KMC Act 1980, depending on the circumstances.
Effective immediately, no new water supply or drainage connections will be permitted, and existing connections may be disconnected in the following scenarios:
•When an entire building is identified as unauthorized by the Building Department, and action has been initiated under section 400(8) of the KMC Act 1980.
•When the entire building is determined to be unauthorized by the Building Department, and a demolition order has been issued by the Special Officer (Building) under section 400(1) of the KMC Act 1980.
•When additional floor(s) have been constructed beyond the sanctioned plan, in violation of the KMC Act 1980 and the prevailing KMC Building Rules 2009, and such construction has not been approved. In this case, if action has been taken under section 400(8) of the KMC Act 1980, or a demolition order has been issued by the Special Officer (Building) under section 400(1) of the KMC Act 1980 for the additional floor(s).
Following the necessary actions for the aforementioned cases, the Director-General (Building) will provide a borough-wise list of such unauthorized constructions on a fortnightly basis to the Director-General of Water Supply and the Director-General of Civil works. This is to facilitate the disconnection of supply or the abstention from providing new connections as required.
