The Government of Himachal Pradesh on May 29, 2024, issued the Draft Himachal Pradesh Lease (4th Amendment) Rules, 2024, to further amend the Himachal Pradesh Lease Rules, 2013.
The following amendments have been stated:
• In rule 7, which states “Sanction of lease”, after the existing provisos, the following proviso shall be added, namely:
o "Provided further that it shall be mandatory for the user agency to execute the lease deed within 6 months after the approval under the Forest Conservations Act, 1980.
• In rule 8, which states “Lease amount”, in clause (i), for the second proviso the following provisoshall be substituted, namely:
o "Provided further that for the Hydro Electric Projects (HEPs) and other infrastructure projects for which Government forest land has been diverted by the State or Central Government, the lease rent/amount shall be charged @ Rs. 5 per Sqmt. per annum;
• In rule 8, which states “Lease amount”, in clause (ii) the following proviso shall be inserted namely:
o "Provided that the project developers who intend to deposit the lease money in one single instalment for the complete 40 years shall be exempted from enhancement being made after every 5 years for the project."
The Objections or suggestions will be considered by the State Govt. within a period of 30 days from May 29, 2024, and may be sent to the Addl. Chief Secretary (Revenue) to the Government of Himachal Pradesh, Shimla-171002.
This notification will come into force from the date of publication in Rajpatra (e-Gazette), Himachal Pradesh.
