The Himachal Pradesh Electricity Regulatory Commission (HPERC) on June 05, 2024, issued the Himachal Pradesh Electricity Regulatory Commission (Terms and Conditions for Determination of Hydro Generation Tariff) Regulations, 2024.
These Regulations shall come into force with effect from the date of their publication in the Official Gazette.
The following provisions have been stated:
•These Regulations shall extend to the whole of the State of Himachal Pradesh.
•These Regulations shall apply to all existing and future Power Generation Companies supplying hydropower under Section 62 of the Electricity Act 2003, and their successors, if any, for the determination of Aggregate Revenue Requirement and Tariff, in all matters covered under these Regulations from April 01, 2024, up to March 31, 2029, unless otherwise reviewed/extended:
Provided that for all purposes, including review matters on the period till March 31, 2024, the issues relating to the determination of Aggregate Revenue Requirement and Tariff shall be governed by the provisions of the Himachal Pradesh Electricity Regulatory Commission (Terms and Conditions of Hydro Generation Tariff) Regulations, 2011, including amendments thereto, as may be applicable.
•These Regulations supersede the ―Himachal Pradesh Electricity Regulatory Commission (Terms and Conditions of Hydro Generation Tariff) Regulations, 2011 and amendments, if any, thereof.
•Where tariff has been determined through a transparent process of bidding under the guidelines issued by the Central Government, the Commission shall adopt such tariff under the provisions of the Act.
•Where a Power Purchase Agreement has been executed between the Generating Company and the utility before the existence of the Commission, the Commission shall determine such tariff under the terms and conditions of such power purchase agreement.
•Where a Power Purchase Agreement has been executed between the Generating Company and the utility after the existence of the Commission and the Power Purchase Agreement has been approved by the Commission, the Commission shall determine such tariff under the terms and conditions of such approved power purchase agreement.
•The Commission shall determine the Aggregate Revenue Requirement and tariff within the Multi-Year Tariff framework and fees, for all matters for which the Commission has Jurisdiction under the Act, for the Supply of Hydro-electricity by a Generating Company, excluding the supply of electricity by captive generating plant and Renewable Energy sources but including hydro generating stations of capacity exceeding 25MW, to a Distribution Licensee.
