The Government of Gujarat on June 07, 2024, issued the Gujarat Private Security Agencies (Regulations) Rules, 2024, in supersession of the Gujarat Private Security Agencies Rules, 2007.
The following has been stated namely: -
• It states that the applications for a license by an Agency shall be submitted online using Form I on the portal, accompanied by an affidavit (Form X), along with electronic proof of fee payment, and if the applicant is a company, firm, or association, Form II for each key member shall be required.
• It states that the Controlling Authority shall grant licenses (Form III) to Private Security Agencies after verifying suitability, operational need, and premises; shall conduct regular inspections, review compliance, and deliver licenses within 15 days post-approval, applications shall be processed within 60 days, allowing for applicant hearing and stated grounds for refusal.
• It states that the register shall be maintained electronically in Form VI by the Agency.
• It states that agencies shall conduct thorough character and antecedent checks, including police verification, residence verification, previous employer checks, Aadhaar verification, credit history checks, and fidelity insurance, for personnel engaged in cash transportation activities to ensure compliance with legal requirements.
• It states that private security agencies shall use secured cash vans equipped with GPS tracking devices and ensure continuous monitoring through redundant communication protocols during cash transportation activities.
• It states that private security agencies shall adhere to a maximum cash limit of five crore rupees per trip for cash vans and deploy secured vans for amounts exceeding ten lakh rupees per trip.
• It states that private security agencies shall equip ATMs with one-time electronic combination locks to prevent pilferage and fraud, and conduct cash loading operations within specified time windows: 07:00 AM to 09:00 PM in urban areas, 07:00 AM to 06:00 PM in rural areas, and 09:00 AM to 04:00 PM in designated Left Wing Extremism (LWE) affected districts.
