The Ministry of Commerce and Industry (MoC&I) on July 02, 2024, issued the Draft Geographical Indications of Goods (Holding Inquiry and appeal) Rules, 2024, to further amend the Geographical Indication of Goods (Registration and Protection) Rules, 2002.
The following amendments have been stated:
• Complaint
o Any person may file a complaint in Form-I through electronic means to the adjudicating officer regarding any contravention committed under sections 38, 39, 40, 41, and 42 of the Act.
• Extension of Time
o The adjudicating officer or the appellate authority may, for reasons to be recorded in writing, where there is a reasonable cause for the delay or failure to act, extend any period specified in these rules till such period as he may think fit.
• Order and Penalties
o Every order under these rules, shall be dated, digitally signed, communicated to all the parties, and also uploaded on the official website of Intellectual Property India.
o All sums realised by way of penalties under this chapter shall be credited to the Consolidated Fund of India.
The objections or suggestions, if any, may be addressed to the Secretary, Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry, Government of India, Vanijya Bhawan, New Delhi-110001 or by e-mail at [email protected] before the expiry of the period of 30 days will be considered by the Central Government.
