The Ministry of Agriculture and Farmers Welfare (MoA&FW) on July 05, 2024, issued the General Grading and Marking (Amendment) Rules, 2024.
This shall come into force on July 05, 2024.
The following has been stated namely, -
• Rule No. 20 “Penalty” shall be substituted, it specifies the penalties under specified sections of the Act apply to unauthorized grading, marking, counterfeiting grade designations, or selling misgraded articles, enforced by the Adjudicating Officer.
• Rule no. 21 shall be inserted “Adjudication proceedings” which outlines that an officer authorized by the Agricultural Marketing Adviser shall report contraventions of specified sections of the Act to the Adjudicating Officer, who conducts inquiries and issues final orders within 90 days, with power to summon witnesses and proceed in the absence of non-appearing persons.
• Rule no. 22 shall be inserted “Appeal” which outlines procedures for filing appeals to the Agricultural Marketing Adviser within 30 days of receiving an order, requiring a concise memorandum of appeal, accompanied by prescribed fees and documents, with the Adviser having the authority to call for relevant documents, conduct inquiries, and dispose of appeals within 60 days, while also allowing for review and reconsideration of orders.
