Industry Specific ComplianceThe Ministry of Health and Family Welfare (MoH&FW) on July 10, 2024, issued the Draft Drugs and Cosmetics (Compounding of Offences) Rules, 2023.

The following provisions have been stated:

• Power to effect these rules:

o The Central Government may, for the purpose of these rules, by notification in the official gazette, appoint any person under these Rules, as compounding authority for the purpose of exercising powers and functions of the Central Government under these rules and for taking measures with respect to matters arisen from these rules.

o The State Government may, for the purpose of these rules, by notification in the official gazette, appoint any person under these rules, as compounding authority for the purpose of exercising such powers and functions of the State Government under these rules and for taking measures with respect to matters arisen from these rules.

• Form and manner of application:

o An applicant may, either before or after institution of prosecution, make an application under section 32(B) of the Act in the Form-1 appended to these rules along with such relevant information and documents, to the compounding authority for compounding of the offence.

The said draft rules will be taken into consideration on or after the expiry of a period of 45 days from July 10, 2024.
