The Government of Karnataka on July 10, 2024, issued the Draft Karnataka Municipalities Model Building (Amendment) Bye-laws, 2024, to further amend the Karnataka Municipalities Model Building Bye-Laws 2017.
They shall apply to such data centres which are established on land or site as an independent activity only. If data centres are established along with other activities in any land or building, then these bye laws shall not be applicable.
The following has been stated:
• In bye law 5, which states “General Building Requirements and Services”:
o After the Table 5.1 and the entries relating thereto, the following shall be inserted, namely:
“Note: However, in case of data centre building, the minimum ceiling height restriction shall not be applicable subject to the following conditions namely:
o No mezzanine floor shall be allowed;
o Regulations applicable to the overall height of the building shall be complied with;
o Structural safety certification from competent authority shall be obtained as applicable; and
o No Objection Certificate (NOC) from the Department of Karnataka State Fire and Emergency Services (KSFES) shall be obtained as applicable.”
The said draft will be taken into consideration after 30 days from July 10, 2024.
Any objection or suggestion which may be received by the State Government from any person with respect to the said draft before the expiry of 30 days will be considered by the State Government.
