The Ministry of Environment, Forest and Climate Change (MoEF&CC) on July 19, 2024, notified the draft Air (Prevention and Control of Pollution) (Amendment) Rules, 2024 to amend the Air (Prevention and Control of Pollution) Rules 1982.
The following has been stated: -
•In Rule 2, after clause (a) the following clause shall be inserted namely: -
(aa) “adjudicating officer” means any officer appointed/notified under section 39A of the Act. (ef) “Presenting Officer” means the officers (or) their authorized representative as per Appendix – B for taking cognizance of non-compliance (or)contravention of the provisions of the Act within their respective jurisdiction and for initiating and presenting the matter before the concerned Adjudicating Officer.
•After Chapter VII and Rule 17, the following Chapter and rules shall be inserted, namely: - Chapter 8 Rule 18. Appointment of Adjudicating Officer.
Any person can submit an objection or suggestion on or after the expiry of sixty days from July 24, 2024.
