The Ministry of Communication on August 28, 2024, issued the draft Telecommunications (Procedures and Safeguards for Lawful Interception of Messages) Rules, 2024.
The following has been stated namely: -
• These rules supersede rules 419 and 419A of The Indian Telegraph Rules, 1951, under the Indian Telegraph Act, 1885, but do not override existing orders related to message interception, which will remain in effect until their specified expiry date.
• Rule 3 states the Interception of messages or class of messages by authorized agencies.
• Rule 4 states the Procedure for implementing an Interception Order.
Objections and suggestions shall be considered till September 29, 2024, and may be sent by post to "the Joint Secretary (Telecom), Department of Telecommunications, Ministry of Communications, Government of India, Sanchar Bhawan, 20, Ashoka Road, New Delhi – 110001”.
