Industry Specific ComplianceThe Ministry of Health and Family Welfare (MoHFW) on September 19, 2024, issued the Draft Food Safety and Standards (Contaminants, Toxins and Residues) Amendment Regulations, 2024 to further amend the Food Safety and Standards (Contaminants, toxins and Residues) Regulations, 2011.

The following has been stated namely: -

• Regulation 2.3 which states “Residue” the sub-regulation 2.3.1 has been substituted namely: -

“2.3.1. Restriction on the use of Pesticides/Insecticides:

(1) The expression “insecticide” shall have the meaning assigned to it in the Insecticide Act, 1968 (46 of 1968).

(2) Subject to the provisions of clause (4), no pesticide/insecticide shall be used directly on the article of food except fumigants registered and approved under the Insecticides Act, 1968 (46 of 1968).

(3) A Tolerance limit of 0.01 mg/kg shall apply for the pesticides/insecticides which are not registered under the Insecticide Act, 1968 (46 of 1968) except in the case of spices and culinary herbs for which the Tolerance limit shall be 0.1 mg/kg.

(4) The pesticides/insecticides specified in column (2) of the table shall not exceed the Maximum Residue Limits (MRL) prescribed in column (4), for the article of food specified in column (3) of the said table”

Objections or suggestions may be sent to addressed to the Chief Executive Officer, Food Safety and Standards Authority of India or sent on email at [email protected] before the period of sixty days from September 19, 2024.
