The Ministry of Health and Family Welfare (MoH&FW) on September 19, 2024, issued the Draft Food Safety and Standards (Contaminants, Toxins and Residues) Amendment Regulations, 2024, to further amend the Food Safety and Standards (Contaminants, Toxins and Residues) Regulations, 2011.
The following amendments have been stated:
• In Regulation 2.3 relating to ‘Residues’, for sub-regulation 2.3.1, the following shall be substituted, namely:
“2.3.1. Restriction on the use of Pesticides/Insecticides:
o The expression “insecticide” shall have the meaning assigned to it in the Insecticide Act, 1968 (46 of 1968).
o Subject to the provisions of clause (4), no pesticide/insecticide shall be used directly on article of food except fumigants registered and approved under the Insecticides Act, 1968.
o Tolerance limit of 0.01 mg/kg shall apply for the pesticides/insecticides which are not registered under the Insecticide Act, 1968 (46 of 1968) except in case of spices and culinary herbs for which Tolerance limit shall be 0.1 mg/kg.
o The pesticides/insecticides specified in the table shall not exceed the Maximum Residue Limits (MRL) prescribed in the article of food specified in the table.
