The Government of Bihar on October 16, 2024, issued the Bihar Minerals (Subsidy, Prevention of Illegal Mining, Transportation and Storage) (Amendment) Rules, 2024, to further amend the Bihar Minerals (Subsidy, Prevention of Illegal Mining, Transportation and Storage) Rules, 2019.
The following amendments have been stated:
• Rule 22(2)(c), which states “Procedure For Grant Of A Mining Lease Except Sand”, shall be substituted as follows:
22 (2) (c) A security deposit equal to 25 (twenty five) per cent of the auction amount, which shall be refunded after the expiry of the settlement period, if the mining lease holder is not otherwise in default in payment. In case of unsuccessful bidder, the earnest money deposit will be refunded to the bidder.
• A new proviso shall be added in Rule-28 Lease Execution (1):
However, the settler shall pay the first instalment along with other dues within 07 (seven) days of receipt of CTE/CTO and present the agreement with all statutory approvals before the District Magistrate for execution.
The agreement will be executed by the District Collector within 03 (three) days of submitting all the amount and legal approval along with the agreement and permission for mining work will be granted. The settlement holder will get it registered within 15 (fifteen) days of execution of the agreement.
This notification will come into force from October 16, 2024.
