The Karnataka State Pollution Control Board (KSPCB) on November 07, 2024, issued notice to aII Manufacturers of Electrical and Electronic Equipment (EEE), Parts, and Components in Karnataka.
This is to inform all manufacturers of Electrical and Electronic Equipment (EEE) and/or its parts, components, consumables, and spare parts, operating within the state of Karnataka, that under the provisions of the E-Waste (Management) Rules, 2022, it is mandatory to register under the Extended Producer Responsibility (EPR) portal of the Central Pollution Control Board (CPCB).
Failure to register under the CPCB EPR portal within 15 days of receiving this notice will result in legal actions under the following legislation:
• Water (Prevention and Control of Pollution) Act, 1974:Sectton 33A provides the power to issue directions, including closure, prohibition, or regulation of any industry, operation, or process in case of non-compliance.
• Air (Prevention and Control of Pollution) Act, 1981: Under Section 31A, actions such as fines, suspension of operations, or legal penalties can be initiated.
• E-Waste (Management) Rules, 2022: Rule 22 stipulates provisions for the imposition of Environmental Compensation (EC) and legal action for failure to comply with EPR obligations.
• The Environment (Protection) Act, 1986: Section 15 and 16 authorize penalties for violations of environmental rules, including fines and imprisonment for non-compliance with environmental regulations.
Non-compliance will invite penalties, including but not limited to revocation of your EPR authorisation, imposition of fines, and legal actions that could impact your business operations.
