The Andaman & Nicobar Administration on October 09, 2024, issued the Draft Industrial Relations (A & N Islands) Rules, 2024.
The following has been stated namely: -
• Chapter III outlines the provisions related to trade unions.
• Chapter VIII outlines the procedures for giving notices of strikes and lock-outs, including who must give the notice, the manner of submission, and the required recipients, with strikes needing approval from union members and lock-out notices displayed by the employer and reported to relevant authorities within five days.
• Chapter IX outlines the procedures for retrenchment, re-employment, and closure, including the requirement for employers to provide notice to the Labour Commissioner, Conciliation Officer, and relevant authorities via registered or speed post and electronically, with specific timelines for retrenched workers' re-employment opportunities and closure notifications.
• Chapter X outlines the procedures for applying for permission related to lay-offs, retrenchment, and closure in certain establishments, including the submission of applications to the Labour Secretary, notice requirements to workers, timelines for reviews, and conditions for continued lay-offs, retrenchments, and closures, with specific forms to be used and communications to be made electronically or via registered post.
• Chapter XII outline the procedures for holding inquiries and compounding offences under the Code, including the appointment of officers, the process for applying to compound an offence, notice requirements, payment of the compounding amount, and the closure of prosecution cases once the offence is compounded.
The objections or suggestions over the said Draft Rules may be sent to the Labour Commissioner and DET, Department of Labour, Supply Lane, Sri Vijaya Puram- 744101 within a period of 30 days from the date of its publication in the Official website of the Department.
