The Government of Himachal Pradesh on November 22, 2024, issued the Himachal Pradesh Panchayati Raj (General) Amendment Rules, 2024 to further amend the Himachal Pradesh Panchayati Raj (General) Rules, 1997.
The following has been stated namely: -
• Rule 135 which states the “Resignation of Office Bearer” has been substituted namely: -
“(1) Pradhan or Up-Pradhan or a member of the Gram Panchayat may resign his office in writing under his hand addressed to the concerned District Panchayat Officer. Resignation can be handed over personally, informing that the resignation is voluntary and genuine to the District Panchayat Officer directly or through Block Development Officer concerned. In case resignation is handed over to the Block Development Officer, he shall immediately forward the same to District Panchayat Officer with his remarks that the resignation is voluntary and genuine. District Panchayat Officer shall accept the resignation immediately if he has no information to the contrary. Resignation can be given either online or by post or through someone else. The District Panchayat Officer concerned may make such enquiry as he thinks fit to satisfy himself that the resignation is voluntary and genuine through the agency of Block Development Office. If the District Panchayat Officer, after making a summary enquiry either himself or through the agency of Block Development office, as he may deem fit, is satisfied that the resignation is not voluntary and genuine, he shall not accept the resignation. In case resignation is found voluntary and genuine he shall accept the same immediately. Resignation can be withdrawn by the Pradhan or Up-Pradhan or the member as the case may be at any time before its acceptance by the District Panchayat Officer.
(2) An office bearer of the Panchayat Samiti may resign his office in writing under his hand addressed to the concerned Deputy Commissioner. Resignation can be handed over personally, informing that the resignation is voluntary and genuine to the Deputy Commissioner directly or through Block Development Officer concerned. In case resignation is handed over to the Block Development Officer, he shall immediately forward the same to Deputy Commissioner with his remarks that the resignation is voluntary and genuine. Deputy Commissioner shall accept the resignation immediately if he has no information to the contrary. Resignation can be given either online or by post or through someone else. The Deputy Commissioner concerned may make such enquiry as he thinks fit to satisfy himself that the resignation is voluntary and genuine through the agency of Block Development Officer. If the Deputy Commissioner after making a summary enquiry either himself or through the agency of Block Development office, as he may deem fit, is satisfied that the resignation is not voluntary and genuine, he shall not accept the resignation. In case resignation is found voluntary and genuine he shall accept the same immediately. Resignation can be withdrawn by the office bearer at any time before its acceptance by the Deputy Commissioner”
This shall come into force on November 22, 2024.
