The Directorate General of Foreign Trade, (DGFT) on December 13, 2024, issued a notification regarding EPCG Scheme Applicability of amendment to Para 5.10(c) of Hand Book of Procedures 2015-20 (Mid-Term Review).
The Division Bench of the Hon'ble High Court of Ahmedabad, in its judgment dated December 21, 2023 (SCA No. 16316/2021, South Gujarat Warp Knitters Association & Another), set aside Policy Circular No. 22/2015-20 dated March 29, 2019 issued by the DGFT. The Hon'ble Supreme Court subsequently dismissed the SLP (Civil) Diary No. 29793/2024 filed by the Union of India on August 02, 2024, affirming the High Court's decision.
In compliance with the above judgments, it is clarified that the amendment to para 5.10(c) of the Handbook of Procedures (HBP), 2015-20 (Mid-term review), is prospective and shall apply only to third-party exports made against EPCG Authorisations issued on or after December 05, 2017.
