Commercial ComplianceThe Ministry of Commerce and Industry (MoC&I) on December 13, 2024, issued the Industries (Development and Regulation) Manner of Holding Inquiry and Appeal Rules, 2024.

This shall come into effect from December 14, 2024.

The following has been stated namely: -

• Rule 3 states that any person may file a complaint in Form 1 through electronic means or speed post or registered post to the adjudicating officer regarding any contravention.

• Rule 4 outlines the process of Holding of Inquiry, it states that an inquiry for adjudication of penalties under Section 24A involves issuing notices, explaining alleged contraventions, providing opportunities for defense, and concluding proceedings within six months.

• Rule 5 outlines the provisions for Appeal, it states that an appeal under Section 24B must be filed within 30 days, include necessary documents, and be resolved by the appellate authority within 60 days after providing an opportunity for a hearing.

• Rule 7 outlines the provisions for orders and penalties, it states that Orders under these rules shall be dated, signed, and communicated, and penalties collected are credited to the Consolidated Fund of India.
