Industry Specific ComplianceThe Government of Nagaland on November 30, 2024, issued the Nagaland Building Byelaws (2nd Amendment) 2024.

The following amendments have been stated:

• After section 17 of the Nagaland Building Byelaws 2012, the section(s) 17A and 17B shall be inserted:

“Section 17A. Industrial Infrastructure and Standalone/ Flatted Factories: The following conditions shall be followed for the construction of industrial buildings and standalone factories. (Provided in the Table)

2. Provided that the shortest side of the plot measures a minimum of 15 meters.

3. The maximum height of an Industrial Building(s) constructed in an allotted site or private holdings, within a notified area shall be in accordance with the suitability and profile of the area location and as per the geotechnical report vetted by the Department of Geology and Mining.

4. The following Setbacks shall be adopted for Industrial (Standalone and Flatted Factories) Plot Area >= 3000 sq. m

(a). For industrial buildings having covered area of 2100 sq. m to 7500 sq. m. fire tenders shall have access to at least half of the perimeter of building which shall be minimum 5.0 m wide with 5.0 m turning radius and the remaining half of the perimeter of the building shall have a minimum 3.0 m setback.

(b). For industrial buildings having covered area of more than 7500 sq. m. fire tenders shall have access to at least half of the perimeter of building which shall be minimum 6.0 m wide with 6.0 m turning radius and the remaining half of the perimeter of the building shall have a minimum 6.0 m setback.

(c). A car parking area of 12.5 Sq. m (2.5 m x 5 m) for every 200 Sq. m of floor area shall be provided within the site.”

“17B Regulations for Central Business Districts and Transit-Oriented Development Corridors: -

(1) Central Business Districts and Transit Oriented Development Corridors shall be notified by the Government.

(2) Commercial buildings in this zone shall have the following regulations. (Provided in the Table)

(3). A car parking area of 12.5 Sq. m(2.5 m x5 m) for every 75 Sq. m of floor area shall be provided within the site.

• After section 75, the Section 76 shall be inserted:

“76. Power to relax:

(1) In case of genuine difficulties arising out of the implementation of any of the byelaws in regard to buildings or structures proposed to be constructed by the Government of Nagaland or Government of India or any registered agencies or organizations, the State Government reserves the right to relax from application of any of the provisions of the said Byelaws which it considers justifiable on the merit of each case.

(2). In case of buildings coming up around High-security zones, Defense areas, Airport and Helipad(s) the height of the building shall be as per the recommendation of the Competent Authority(s) concerned, and also a radius of 200 feet shall be maintained as no construction/development zone around aerodromes and helipads.”

• In 25 of the Nagaland Building Byelaws 2012, subsection 25 (vi) has been inserted:

“Section 25(vi). Allow Construction of Hostels in Industrial Zones.

"The Master Plans for Kohima capital city and Dimapur commercial city, which are under preparation, and which allows mixed land-use for residential development, permission for construction of Hostels and Dormitories for residential purpose of Industrial workers are permitted in the Industrial zones, provided that construction for such use shall not exceed 25% of the permissible ground coverage”
