Kerala Govt. issued a notification regarding the transportation of waste from waste storage facilities

EHS ComplianceThe Government of Kerala on January 31, 2025, issued a notification regarding the transportation of waste from waste storage facilities.

It is stated that Local Self-Governments contractually engage the Clean Kerala Company and private agencies to transport waste from waste storage facilities such as Material Collection Facility (MCF)/Resource Recovery Facility (RRF) to disposal/recycling sites. The guidelines for monitoring and controlling the movement of vehicles used for the said waste movement were issued vide reference in the context of the judgment dated July 29, 2021, of the Hon'ble National Green Tribunal in Case No. OA 100/2021. After this, the Additional Chief Secretary of the Local Self-Government Department became the Chairman of the State Level Committee; District Level Committees were also constituted with District Collectors as Chairman.

In the context of the incident of dumping of garbage including, a case was voluntarily registered as OA 312/2024(SZ) by the Chennai South Region Bench of the Hon'ble National Green Tribunal. After observing the recurrence of such illegal waste deposits, the Hon'ble Tribunal ordered to strengthen border security and prevent illegal waste disposal in the neighbouring states.

The Government has examined the matter in detail. Guidelines for monitoring and control, including the movement of vehicles used for transporting waste from material collection facility (MCF)/ resource recovery facility (RRF) to disposal/recycling sites, are issued, codified and clarified as detailed below:

• Recyclable inorganic waste shall be charged to recycling agencies or waste collection agencies at a rate not less than that fixed by the Clean Kerala Company.

• Local Self-Government bodies for waste disposal with authorized agencies of Sanitation Mission/Clean Kerala Company Ltd. dated November 04, 2024 S.U. (Sadha) No. 2092/2024/LSGD to be entered into the contract.

• The Local Self-Government bodies shall strictly follow the procedure for selecting the agencies mentioned above.

• Contract shall disclose the place for treatment of the inorganic waste collected by the agencies so selected.

• Vehicles used by the agencies for waste movement shall be registered with the local authority/CKCL designating the agencies. A separate register shall be maintained by the local body/CKCL to record the details of the said vehicles. Annexure Specimen of Application Form for Registration of Vehicles as such Added as

• Transportation of waste should be carried out only in a securely covered vehicle.
