The Central Electricity Regulatory Commission (CERC) on February 04, 2025, issued the Central Electricity Regulatory Commission (Terms and Conditions of Tariff) (First Amendment) Regulations, 2025, to further amend the Central Electricity Regulatory Commission (Terms and Conditions of Tariff) Regulations, 2024.
The following has been stated namely: -
• In Regulation 3, after sub-regulation 9, a new sub-regulation (9A) shall be inserted, it states that “Bank Rate” means the one-year Marginal cost of the lending rate as specified by the State Bank of India from time to time or any replacement thereof for the time being in force plus 100 basis points.”
• In Regulation 36, in the first proviso to clause (d) of sub-regulation (3), the number “0.09%” shall be substituted with “0.12%”.
• In Regulation 55, the words “Ministry of Coal, Government of India” shall be substituted with, “the Central Government”.
• In Regulation 64, in the second proviso to clause (d) of sub-regulation (3), the words and expression “clause (5)” shall be substituted by “clause (6)”.
• In Regulation 70(A), in clause (b), the words “or thereafter, except those covered under clauses (c), (d) and (e);” shall be added after the words “as on 31.03.2024”.
• These regulations shall come into force from April 01, 2024.
