The Government of Madhya Pradesh on 14, 2025, issued amendments in the Madhya Pradesh Beer and Wine Rules, 2002.
The following amendments have been stated:
• In rule 3-А, in sub-rule (2), for clause (b), the following clause shall be substituted, namely:-
"(b) (i) F.L.-2, F.L.-3 and F.L.-4 licensee, who have a minimum 2000 square feet of additional space for setting up plant and machinery in their premises separately;
(ii) persons who are operating a restaurant/hotel under a food licence and fulfil the following conditions, namely:-
(a) age must be minimum of 21 years and there must be no criminal record;
(b) the applicant must have e-KYC;
(c) a minimum of 2000 square feet of extra space must be available in their premises for setting up plant and machinery separately;
(d) the licenced premises must have an air- conditioned restaurant with a dining area/serving area of minimum 1500 square feet;
(e) the licenced premises must have separate toilets for men and women;
(f) there must be an adequate arrangement of own or public parking;
(g) the restaurant/hotel must be in accordance with the rules of location of liquor shops.
(iii) the applicants mentioned in sub-clause (i) and (ii) must submit an affidavit stating that they shall spend a minimum of Rs. 50 lakh on plant and machinery for the establishment of a microbrewery.";
• In rule 3-А, in sub-rule (3), for clause (ii), the following clause shall be substituted, namely:-
"(ii) An affidavit by the applicant, as mentioned in sub-clause (i) and (ii) of clause (b) of sub-rule (2) of rule 3-A of the said rules to spend a minimum of Rs. 50 lakh on plant and machinery for setting up the microbrewery.".
• In rule 4-A, in sub-rule (1), after clause (v), the following clause shall be added, namely:-
"(vi) Sale of liquor is an exclusive privilege and right of the State, the State cannot be compelled to grant to anybody and no one can claim it as a right against the State i.e. mere fulfillment of the prescribed formalities/arrangements shall not entitle any particular applicant to put up a claim for grant of microbrewery licence. The decision of the Excise Commissioner in this regard shall be final.".
They shall come into force on February 14, 2025.
