The Telecom Regulatory Authority of India (TRAI) on February 12, 2025, issued the Telecom Commercial Communications Customer Preference (Second Amendment) Regulations, 2025, to further amend the Telecom Commercial Communications Customer Preference Regulations, 2018.
The following has been stated namely: -
• These regulations shall apply throughout the territory of India.
• Regulation 2 which states “Definitions” the following has been inserted namely: -
“(za) “Government Message or Government Voice Call” means any message sent or voice call made on the directions of –
(a) the Central Government or the State Government or any body established under the Constitution; or
(b) the Authority or by an agency expressly authorized for the purpose by the Authority”
• Regulation 3 which states “Commercial Communication Through Access Provider Network” has been substituted namely: -
“Every Access Provider shall ensure that any commercial communication using its network takes place only using registered headers or the number resources allotted to the Senders from special series assigned for the purpose of commercial communication.”
• Regulation 4 which states “Intimation regarding use of Auto Dialer or Robo-Calls” has been substituted namely: -
“Every Sender shall notify the Originating Access Provider, in advance, about the use of Auto Dialer or Robo-Calls as well as the intended objective of such calls in writing.”
• Regulation 34A which states “Prohibition on blocking designated number series by Call Management Applications” has been inserted.
These shall come into force after thirty days from February 12, 2025 except regulation 8, regulation 17; sub-clauses (a) and (b) of regulation 20; and sub-clause (b) of regulation 21, which shall come into force after sixty days from February 12, 2025.
