The Food Safety and Standards Authority of India (FSSAI) on February 18, 2025, notified regarding the mandatory update of Form IX Nominees details by FBOs and auto-approval provision for Non-Form C modifications in FoSCoS.
The following has been stated namely: -
• It has observed that many Food Business Operators (FBOs) fail to update Form IX nominee details upon personnel changes, violating Rule 2.5.2 of the Food Safety and Standards Rules, 2011, and relevant FSS (Licensing and Registration) Regulations, which mandate timely updates to the Licensing Authority on nominee changes, business modifications, and compliance conditions.
• It states that FBOs shall ensure accurate and updated Form IX details in compliance with FSSAI regulations, as failure to do so attracts penalties under Section 58 of the FSS Act, 2006.
• It further states that from February 12, 2025, Form IX modifications can be made in FoSCOS without approval or fees, and strict compliance is required.
