The Lok Sabha on March 11, 2025, issued the Immigration and Foreigners Bill, 2025.
The following has been stated namely: -
• The bill aims to overhaul India's immigration framework by replacing the Foreigners Act, 1946, and the Passport (Entry into India) Act, 1920.
• All individuals entering or exiting India must possess valid passports and visas. Foreigners are required to register upon arrival, with their movements, name changes, and access to certain areas potentially restricted.
• The bill empowers authorities to deny entry or stay to foreigners deemed threats to national security, sovereignty, or integrity. Immigration officers are granted the authority to arrest individuals without a warrant if suspected of violating immigration laws.
• Violations of immigration regulations carry severe consequences. Arriving without valid documents can result in up to five years in prison and fines up to ₹5 lakh. Using forged documents may lead to two to seven years of imprisonment, with fines ranging from ₹1 lakh to ₹10 lakh. Overstaying or breaching visa conditions could incur up to three years in prison and fines up to ₹3 lakh. Transport carriers facilitating the movement of foreigners without proper documentation can face fines up to ₹5 lakh and potential seizure of their vehicles.
• Airlines and other transport carriers are held accountable for ensuring passengers have valid documents. Failure to comply can result in substantial fines and the possible confiscation of vehicles if penalties remain unpaid.
• Educational institutions, hospitals, and nursing homes must report the presence of foreign nationals to immigration authorities, enhancing oversight and compliance.
