Labour ComplianceThe Ministry of Home Affairs (MHA), on January 2, 2026, has exercised powers under Article 239(1) of the Constitution to delegate the functions of the “appropriate Government” or “State Government” under the Occupational Safety, Health and Working Conditions Code, 2020 to the Administrators/Lieutenant Governors of specified Union Territories.

Accordingly, the Administrator or Lieutenant Governor of the National Capital Territory of Delhi, Andaman and Nicobar Islands, Dadra and Nagar Haveli and Daman and Diu, Chandigarh, Puducherry, Lakshadweep, Ladakh, and Jammu and Kashmir shall, subject to the control of the President and until further orders, exercise all powers and discharge all functions under the Occupational Safety, Health and Working Conditions Code, 2020 in areas where these Union Territories are required to function as the appropriate Government or State Government.

This notification supersedes earlier notifications S.O. 272(E) dated January 16, 2023, and S.O. 2749(E) and S.O. 2751(E) dated June 22, 2023, without affecting actions already taken or omitted prior to such supersession.
