Labour ComplianceThe Government of Rajasthan on January 12, 2026, issued the Rajasthan Code on Social Security (Draft) Rules, 2026. 

The key provisions are as stated:

Term & Membership

o Non–ex-officio members hold office for up to 3 years; re-nomination allowed.

o Membership ends if the member no longer represents the concerned category or constituency.

o Representation must include SC, ST, minorities, and women as specified.

Resignation & Vacancy

o Members (other than ex-officio) may resign in writing.

o Vacancy takes effect on acceptance or after 30 days, whichever is earlier.

o Vacancies are filled by the State Government for the remaining term only.

Vacation & Removal

o Office vacated on disqualification, absence from three consecutive meetings, loss of representative status, or removal by the State Government.

Meetings & Quorum

o Board meets at least once every quarter.

o Quorum: six members, including at least one MLA.

o Decisions taken by majority vote; Chairperson has a casting vote.

Allowances & Fees

o Non-official members receive TA/DA as per Category ‘A’ State officers.

o Sitting fee: ₹500 per meeting; Chairperson honorarium: ₹4,000 per month.

Sub-Committees

o Board may form sub-committees for specific functions.

o Term generally one year, extendable but not beyond two years.

o Recommendations placed before the Board for final decision.

Board Composition (Rajasthan BOCW Welfare Board)

o Chairperson: Labour Minister (ex-officio).

o Equal representation of workers, employers, and State Government.

o At least one woman member mandatory.

Powers & Functions

o Administration of welfare fund, policy decisions, budgeting, audits, recovery of dues.

o Framing and implementing welfare schemes with State Government approval.

Administration

o Secretary (Chief Executive Officer) appointed with State approval.

o Secretary exercises delegated administrative and financial powers.

o Board may open district and tehsil offices.

Welfare Schemes

o Includes group insurance premium, education schemes for beneficiaries’ children, and other approved benefits.

The said draft rules will be taken into consideration after the expiry of a period of forty-five days from the date on which the copies of the Official Gazette in which the draft rules are published are made available to the public;

The objections and suggestions, which may be received from any person with respectto the said draft rules before expiry of the period specified above, will be considered by the State Government.
