The Rajasthan State Pollution Control Board (RSPCB) on January 09, 2026, notified regarding the Special Dispensation Scheme.
The following has been stated namely: -
• It states that under the provisions of the Water (Prevention and Control of Pollution) Act, 1974, and the Air (Prevention and Control of Pollution) Act, 1981, industries and service-sector units are required to obtain prior Consent to Establish (CTE) and Consent to Operate (CTO). Noting that several hotels and service-sector establishments have been operating without a valid CTO, the State Pollution Control Board has introduced a Special Dispensation Scheme to encourage compliance.
• Under this scheme, hotels and other service-sector units such as resorts, hospitals, marriage gardens, institutions, shopping malls, automobile service stations, call centres, BPOs, etc., which are operating without a CTO, are allowed to apply for consent up to January 31, 2026. Eligible units must apply for both CTE and CTO as per the prescribed procedure and fees under the Water and Air Acts. However, as a one-time relaxation, such units are exempted from payment of back-period consent fees for the years they were in operation without consent.
• The scheme also covers units whose consent applications are already pending with the State Board, regardless of the date of application, though no refund of back-period fees will be granted in cases already disposed of earlier.
• All Regional Officers and Group In-charges have been directed to process applications received under this scheme on priority, and all such applications must be disposed of within 60 days from the date of receipt.
