The Ministry of Road Transport and Highways (MoRTH) on January 14, 2026, issued the Central Motor Vehicles (Second Amendment) Rules, 2026, to further amend the Central Motor Vehicles Rules, 1989.
The following has been stated namely: -
• Rule 2 which states “Definition” the following has been inserted namely: -
“(ze) "unpaid user fee" means the user fee payable by a motor vehicle for use of a section of a National Highway, where the Electronic Toll Collection Infrastructure has recorded the passage of such vehicle but has not received the applicable user fee levied under the provisions of section 7 of the National Highways Act, 1956 (48 of 1956) and rules made thereunder.”
• Rule 55 which state “Transfer of ownership” the following clause shall be inserted in sub-rule (2) namely: -
“(v) No objection certificate in Form 28”
• Rule 90 which states “Additional conditions for national permit” the following clause shall be inserted namely: -
“(7) The vehicle shall not have any unpaid user fee”
This shall come into force on January 14, 2026.
