The National Medical Commission (NMC) on February 17, 2026, issued the Draft Establishment of New Medical Institutions, Starting of New Medical Courses, Increase of Seats for Existing Courses & Assessment & Rating (Amendment) Regulations, 2026 to further amend the “Establishment of New Medical Institutions, Starting of New Medical Courses, Increase of Seats for Existing Courses & Assessment & Rating Regulations, 2023.
The following has been stated: -
•Clause 6(a) and Clause 9(c) are deleted, and Clause 6(g) is revised to include companies incorporated under the Companies Act, 2013, with a new Clause 6(h) inserted to include registered trusts.
•Clause 9 is reworded to specify mandatory documents, including a valid Essentiality Certificate (with exemption for existing colleges starting new PG courses), a valid Consent of Affiliation, and a solvency certificate issued within 90 days.
•Incomplete applications without mandated documents will be treated as invalid under Section 28(2) of the National Medical Commission Act, 2019, and rejected without opportunity under Section 28(3).
•A new provision under Clause 15 mandates submission and maintenance of a corpus fund for new and existing medical colleges, as determined by the Medical Assessment & Rating Board (MARB).
•Clause 31(c) is amended to allow withholding or rejection of applications for new schemes or seat increases for a specified academic year or number of years.
They shall come into force from February 20, 2026.
