EHS ComplianceThe Government of Uttar Pradesh on February 03, 2026, issued the Uttar Pradesh Brick Kilns (Sitting Criteria for Establishment) (First Amendment) Rules, 2026, further to amend the Uttar Pradesh Brick Kilns (Sitting Criteria for Establishment) Rules, 2012.

The following has been amended:

• The amendment increases the minimum distance requirement from existing brick kilns from 800 meters to 1 kilometer. It mandates that no kiln shall be established within 5 kilometers of a Municipal Council, Municipal Corporation, or Nagar Panchayat, with a uniform minimum distance of 800 meters from habitation. 

• It also validates brick kilns established before 27 June 2012, subject to proof of approvals, while imposing a penalty of three times the annual fee for those that operated without prior consent. 

• Further, emission standards and pollution control systems, including chimney height, are aligned with the updated 2022 notification issued under the Environment (Protection) Rules, 1986. 

• The amendment additionally empowers authorities to enforce stricter measures in sensitive areas affected by poor air quality. It assigns responsibility to district administration, police, and pollution control authorities for executing closure orders.
