The Government of Uttarakhand on April 30, 2026, issued the Draft Uttarakhand Social Security Code Rules, 2026. They shall extend to the whole of the State of Uttarakhand.
The notification lays down detailed provisions for the constitution, functioning, and governance of the Uttarakhand Unorganized Workers Social Security Board and the Uttarakhand Building and Other Construction Workers Welfare Board. The Social Security Board is to be constituted by the State Government for a three-year term, comprising representatives from unorganized workers, employers, legislators, experts, and government departments, ensuring representation of Scheduled Castes, Scheduled Tribes, minorities, and women. The State Government is also responsible for timely reconstitution of the Board and may make interim arrangements if delays occur.
The rules specify the tenure, resignation, disqualification, and removal of members. Non-official members can serve up to two terms of three years each, and must vacate their position if they no longer represent their respective category. Members may resign through written communication, and vacancies are filled by the State Government for the remaining term. The State Government retains final authority on disqualification and removal matters. Members are also required to update their address details, and allowances for attending meetings are provided as per prescribed norms.
The functioning of the Social Security Board is governed through structured procedures for meetings, decision-making, and quorum. The Board must meet at least once every three months, with provisions for special and emergency meetings. Decisions are taken by majority, with the Chairperson having a casting vote in case of a tie. A minimum quorum of one-fourth members is required, and the State Government has powers to supersede the Board in cases of non-performance, with mandatory reporting to the State Legislature.
Similarly, the Building and Other Construction Workers Welfare Board is constituted with representation from government, employers, and workers, including at least one woman member. It follows comparable provisions regarding tenure, resignation, disqualification, and filling of vacancies. The Board performs functions as per the Code, with meetings, procedures, and governance aligned with rules prescribed by the Central Government. The Secretary acts as the Chief Executive Officer and is responsible for administration, convening meetings, and implementing Board decisions.
Any representations and objections relating to this notification by the beneficiaries and the general public affected by the said rules may be sent to Secretary, Labour Department, Government of Uttarakhand, 4 B Subhash Road, Uttarakhand Secretariat, Dehradun, Uttarakhand ([email protected]) and Labour Commissioner, Uttarakhand ([email protected]) within 45 days from the date of publication of this notification in the newspaper/ website.
