The Delhi Electricity Regulatory Commission (DERC), through the Delhi Electricity Regulatory Commission (Terms and Conditions for Green Energy Open Access) (First Amendment) Regulations, 2026, notified amendments to the Delhi Electricity Regulatory Commission (Terms and Conditions for Green Energy Open Access) Regulations, 2024, which came into force from the date of publication in the Official Gazette.
The amendment removes the requirement that consumers must be connected at 11 kV or above to qualify as an “Entity” or a “Green Energy Open Access Consumer.” As amended, any consumer having a contract demand or sanctioned load of 100 kW or more, either through a single connection or multiple connections aggregating 100 kW or more within the area of supply of the same distribution licensee, will be eligible to avail Green Energy Open Access. This significantly broadens access to green energy procurement for eligible consumers irrespective of their voltage level of connection.
The amendment also provides that captive consumers and consumers with captive generating plants will not be subject to any load limitation for setting up green energy projects with respect to their contracted demand or sanctioned load with distribution licensees. Corresponding changes have been made to the eligibility provisions under Regulation 8 to align with the revised definitions and facilitate greater adoption of renewable energy and green power procurement in the National Capital Territory of Delhi.
