The Ministry of Housing and Urban Affairs (MoHUA), on July 1, 2026, notified the Dadra and Nagar Haveli Real Estate (Regulation and Development) (General) Amendment Rules, 2026 to align the Union Territory's RERA framework with the amendments introduced under the Jan Vishwas (Amendment of Provisions) Act, 2026. The amendment has been made pursuant to changes in Section 68 of the Real Estate (Regulation and Development) Act, 2016 (RERA).
The amendment omits the entry in Rule 33 of the Dadra and Nagar Haveli Real Estate (Regulation and Development) (General) Rules, 2016 that prescribed a penalty of ten per cent of the estimated cost of the plot, apartment, or building for offences punishable with imprisonment under Section 68 of the Act. This amendment gives effect to the decriminalisation of the relevant offence introduced through the Jan Vishwas (Amendment of Provisions) Act, 2026.
The amended Rules came into force on July 1, 2026, i.e., the date of their publication in the Official Gazette, and are intended to harmonise the penalty framework under the Dadra and Nagar Haveli RERA Rules with the revised provisions of the Real Estate (Regulation and Development) Act, 2016.
