The Labour Department of Chandigarh on July 08, 2020 releases the Transparent Inspection Policy, 2020 with an objective to regulate the implementation of statutory provisions under various labour laws in transparent and accountable manner through wide scale adoption of technology and innovation and to protect the rights of workers in relation to their safety, health and welfare as also other conditions of employment in the spirit and manner as envisaged under the law
Following guidelines have been given in Transparent Inspection Policy, 2020:
• All the factories and establishments employing less than 50 workers and who have opted for the “Self-Certification Scheme” and have submitted a single return under various labour laws have been exempted from labour inspections under all labour laws.
• All start-up establishments for a period of two years from the date of commencement of work/ business except the inspections covered under the Building and Other Construction Workers’ (Regulation of Employment and Conditions of Service) Act, 1996 have been exempted as well.
• Inspections shall be carried out in the manufacturing units based on the three levels of hazards categories namely major accident hazardous, hazardous, and non-hazardous.
• Every Major Accident Hazardous unit shall be inspected once in a year. All the Hazardous units involving risk of fire, explosion and toxic release are to be inspected once in every two-years and the rest of the units, which are Non-Hazardous are to be inspected once in every five years.
• All shops and establishments shall be divided in categories namely employing up to 4 persons, employing up to 5 or more persons and employing 100 or more persons.
• All shops and establishments employing up to 4 persons shall be exempted from inspection. All shops and establishments employing 5 or more persons shall be inspected once in every five years and all shops and establishments employing 100 or more persons shall be inspected once in every two years.
• There should be a preparation of the quarterly list of inspection through a computerized system. A notice of the inspection shall be sent over. The report of inspection shall be uploaded on the website.
• The Transparent Inspection Policy shall not apply to inspection concerning Child Labour and Bonded Labour.
